What form do you have to fill out in order to solicit funds in South Carolina?

Generally, all 501(c)3 nonprofits are required to file a registration statement with the Secretary of State’s Public Charities Division.
To be in good standing, an organization needs to submit one of two forms:
- Registration Statement for a Charitable Organization ($50 filing fee), or
- Application for Registration Exemption (Free)
Both must be filed annually, and can be filed online.
There is a long list of possible qualifications for the exemption, but the ones that are most pertinent for 501(c)3s are:
“[If] Fundraising activities are not conducted by professional solicitors, professional fundraising counsel, or commercial co-venturers and you are … a charitable organization which:
(a) does not intend to solicit or receive contributions from the public in excess of $20,000.00 in a calendar year and
(b) has received a letter of tax exemption from the Internal Revenue Service, if all functions, including fundraising activities, of the organization exempted pursuant to this item are conducted by persons who are compensated no more than $500.00 in a year for their services and no part of their assets or income inures to the benefit of or is paid to an officer or a member”
(You will need to provide a copy of any determination letter recognizing the charitable organization’s tax-exempt status from the Internal Revenue Service and any changes, amendments, or revocations to that letter)
“Regardless of whether your fundraising activities are conducted by professional solicitors, professional fundraising counsel, or commercial co-venturers and you are … a charitable organization that does not intend to solicit or receive contributions from the public in excess of $7,500.00 during a calendar year.”
If your organization does not qualify for the exemption, then you need to file the Registration Statement, and include with it a list of your Board of Directors, and your 990, 990EZ, or 990PF (If you do not automatically send it to them). If an organization files the 990N (e-postcard), then you must submit the annual financial report form.
